These Terms of Service ("Terms") govern your use of the WakeUpr mobile application (the "App"), provided by ThinkBit Apps, an individual developer operating under an Apple Developer individual account and based in Bangladesh ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to these Terms. If you don't agree, please don't use the App.
WakeUpr is an alarm app that requires you to complete a short "mission" (such as solving a puzzle, taking a verification photo, or completing an exercise) to dismiss an alarm, along with streaks, achievements, and other gamified features to help build a consistent wake-up routine. Depending on the features you choose to enable, the App may also offer: sleep tracking and a smart-wake window using your device's sensors and/or Apple Health data; and a social "Squad" feature for sharing progress with other users.
WakeUpr is a best-effort tool and is not a substitute for a reliable primary alarm when timing is critical (for example, medication schedules, medical needs, or situations where being late has serious consequences). Alarms can be affected by factors outside our control, including but not limited to: your device's operating system, battery-saving or "Do Not Disturb" settings, silent/mute switches, low battery or power-off state, app updates, and OS-level restrictions on background apps. To the fullest extent permitted by law, we are not liable for missed alarms, oversleeping, or any resulting damages or losses.
Sleep tracking is not a medical device and is not a substitute for professional medical advice, diagnosis, or treatment. Sleep stages, snore detection, heart rate, and other measurements shown in the App are estimates for personal informational purposes only, derived from your device's sensors and/or Apple Health, and may be inaccurate. Always consult a qualified healthcare provider with any questions about a medical condition or before making health decisions. Smart-wake (waking you early within your chosen window based on detected sleep state) is a best-effort feature and, like all alarms in the App, is subject to the same reliability limitations described above — it may not fire at the ideal moment, or at all.
You may use the App as a guest, or create an account using an email/password or a third-party sign-in (Google or Apple). You're responsible for keeping your account credentials secure and for all activity under your account.
You agree not to: use the App for any unlawful purpose; attempt to interfere with, disrupt, or reverse-engineer the App; misuse the mission-verification features to defeat their intended purpose; or use the App in a way that infringes on the rights of others.
The App, including its design, graphics, and content (but excluding your own data), is owned by ThinkBit Apps and protected by copyright and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the App for your personal, non-commercial use.
The App relies on third-party services (such as Supabase, RevenueCat, Superwall, Google, Apple, and Together.ai) to operate, and on Apple's own on-device Health framework for the optional features described in Section 1. We aren't responsible for outages, errors, or issues caused by these third parties, though we'll work to resolve them where we can.
You may stop using the App and delete your account at any time by contacting us. We may suspend or terminate your access to the App if you violate these Terms.
The App is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, and non-infringement.
To the fullest extent permitted by law, ThinkBit Apps will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the App.
We may update these Terms from time to time. We'll update the "Last updated" date above when we do, and for material changes we'll provide additional notice in the App where appropriate. Continued use of the App after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the People's Republic of Bangladesh, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the App will be subject to the exclusive jurisdiction of the courts of Bangladesh.
